By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to Simbalang.
Simbalang is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.
The simbalang app stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the simbalang app won’t work properly or at all.
You should be aware that there are certain things that Simbalang will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but Simbalang cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.
If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.
Along the same lines, Simbalang cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Simbalang cannot accept responsibility.
With respect to Simbalang’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Simbalang accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.
At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for both systems(and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. Simbalang does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.
If you purchase an auto-renewing periodic subscription through the Service, your Simbalang account will be billed continuously for the ubscription until you terminate it as set forth below. After your initial subscription period, and again after any subsequent subscription eriod, your subscription will automatically renew for an additional equivalent period. If you do not wish your subscription to renew utomatically, or if you want to change or terminate your subscription, you will need to log in to your Simbalang account and follow instructions o terminate or change your subscription, even if you have deleted your account.
Simbalang may manage, regulate, control, modify, or eliminate Virtual Items at any time, with or without notice. Simbalang may update the pricing f Virtual Items at any time in its sole discretion, and may add new Virtual Items for additional fees. Simbalang shall have no liability to you r any third party in the event that Simbalang exercises any such rights.
The transfer of Virtual Items is prohibited except where expressly authorized in the Service. Other than as expressly authorized in the Service, ou shall not sell, redeem or otherwise transfer Virtual Items to any person or entity, including but not limited to Company, another user, or ny third party.
You agree to pay all fees and applicable taxes incurred by you or anyone using a Simbalang account registered to you. Simbalang may revise the ricing for the goods and services offered through the Service at any time. All information that you provide in connection with a purchase or ransaction or other monetary transaction interaction with the Service must be accurate, complete, and current. You agree to pay all charges ncurred by users of your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary ransaction interaction with the Service at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, elating to any such purchases, transactions or other monetary transaction interactions.
All financial transactions made in connection with the Service will be processed by a third party in accordance with their respective terms of se, privacy policy, and/or any applicable payment terms and conditions. We encourage you to learn about the practices of such third party. In no vent will Simbalang be responsible for the actions or inactions of any third party payment processor, including, but not limited to, system owntime or payment service outages.
In the event that Simbalang suspends or terminates your use of the Service or these Terms and Conditions or you close your account voluntarily, ou understand and agree that you will receive no refund or exchange of any kind, any Content or data associated with your use of the Service, or or anything else.
The Service may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or ontrolled by Simbalang. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or ervices. If you access any third party website, service, or content from Simbalang, you understand that these Terms and Conditions and our rivacy Policy do not apply to your use of such sites. You expressly acknowledge and agree that Simbalang shall not be responsible or liable, irectly or indirectly, for any damage or loss arising from your use of any third-party website, service, or content. The Service may include advertisements, which may be targeted to the Content or information on the Service, or other information. The types and xtent of advertising by Simbalang on the Service are subject to change. In consideration for Simbalang granting you access to and use of the ervice, you agree that Simbalang and its third party providers and partners may place such advertising in connection with the display of content r information submitted by you or others.
The service, including all images, audio files and other content therein, and any other information, property and rights granted or provided to ou by Simbalang are provided to you on an “as is” basis. Simbalang and its suppliers make no representations or warranties of any kind with espect to the service, either express or implied, and all such representations and warranties, including warranties of merchantability, fitness or a particular purpose or non-infringement, are expressly disclaimed. without limiting the generality of the foregoing, Simbalang does not make ny representation or warranty of any kind relating to accuracy, service availability, completeness, informational content, error-free operation, esults to be obtained from use, or non-infringement. access and use of the service may be unavailable during periods of peak demand, system pgrades, malfunctions or scheduled or unscheduled maintenance or for other reasons. some jurisdictions do not allow the exclusion of implied arranties, so the above exclusion may not apply to you.
In no event will Simbalang be liable to you or any third party claiming through you (whether based in contract, tort, strict liability or other heory) for indirect, incidental, special, consequential or exemplary damages arising out of or relating to the access or use of, or the nability to access or use, the service or any portion thereof, including but not limited to the loss of use of the service, inaccurate results, oss of profits, business interruption, or damages stemming from loss or corruption of data or data being rendered inaccurate, the cost of ecovering any data, the cost of substitute services or claims by third parties for any damage to computers, software, modems, telephones or ther property, even if Simbalang has been advised of the possibility of such damages. Simbalang’s liability to you or any third party claiming hrough you for any cause whatsoever, and regardless of the form of the action, is limited to the amount paid, if any, by you to Simbalang for he service in the 12 months prior to the initial action giving rise to liability. This is an aggregate limit. The existence of more than one laim hereunder will not increase this limit.
Simbalang may terminate your access and use of the Service immediately at any time, for any reason, and at such time you will have no further ight to use the Service. You may terminate your Simbalang account at any time by following the instructions available through the Service. The rovisions of these Terms and Conditions relating to the protection and enforcement of Simbalang’s proprietary rights, your representations and arranties, disclaimer of representations and warranties, release and indemnities, limitations of liability and types of damages, ownership of ata and information, governing law and venue, and miscellaneous provisions shall survive any such termination.
All content available through the Service, including designs, text, graphics, images, information, software, audio and other files, and their election and arrangement (the “Service Content”), are the proprietary property of Simbalang or its licensors. No Service Content may be odified, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted, or sold in any form or by ny means, in whole or in part, other than as expressly permitted in these Terms and Conditions. You may not use any data mining, robots, craping or similar data gathering or extraction methods to obtain Service Content. As between you and Simbalang, all data, information and aterials generated from your access and use of the educational activities made available on or through the Service, including translated content enerated by you (collectively, the “Activity Materials”), shall be exclusively owned by Simbalang, and you shall not have any right to use such ctivity Materials except as expressly authorized by these Terms and Conditions. Activity Materials will not include Translation Materials.
